By using our services, you confirm that you are of legal age in your country of residence, or that you are using the services under the supervision and consent of a legal guardian.
If you create an account, you are responsible for keeping your login details confidential and for all activities that occur under your account.
You must ensure that your information is accurate, current, and complete.

Contract Formation
By placing an order in our online shop, you submit a binding offer to enter into a purchase contract.
The contract is concluded once we confirm your order by email (order confirmation).
We may decline orders for legitimate reasons (e.g. incomplete information, payment issues, suspected misuse).

Print-on-Demand Products
All products are made to order using print-on-demand production.
Small variations in color, print placement, or size may occur due to the production process and do not constitute a defect.
We strive to display product colors and details as accurately as possible, but screen representations may differ from the actual product.

Personal Use
You confirm that your purchases are for personal use or use within your household and not for commercial resale.

Order Process
After placing an order, you will receive an order confirmation by email.
Production starts shortly thereafter via selected production partners.
Once production has started, changes or cancellations are usually no longer possible.

Pricing & Promotions
All prices are listed in euros (€).
Currency conversion may apply at checkout depending on your payment provider.
Prices include VAT unless stated otherwise.
Shipping costs are displayed during checkout.
Prices, discounts, and promotions may change at any time.
The price shown at the time of your order and confirmed in the order confirmation applies to that purchase.

Payment
Accepted payment methods are those shown during checkout (e.g. credit card, PayPal, Klarna, Apple Pay).
You agree to provide current, complete, and accurate billing and payment information so that we can process your order.

Production & Delivery
Because all items are produced individually, the average production and delivery time is 5–10 business days, depending on the production partner and destination.
Delivery times are non-binding estimates and may vary due to production or shipping delays or events outside our control.
For consumers, the risk of loss or damage to the goods passes to you only when the goods are delivered to you or to a person authorized by you to receive them.

Right of Withdrawal & Returns
Your right of withdrawal and the conditions for returns are governed by our Refund and Withdrawal Policy.
Because our items are made to order using print-on-demand production, the right of withdrawal does not apply where statutory law excludes it.
This does not affect your statutory rights in the event of defective or damaged goods.

Privacy
All personal data collected during the shopping process is processed in accordance with our Privacy Policy.

Faulty or Damaged Items
If your item is faulty or damaged, please contact us at ocean@seablub.com with a description and, if possible, photos of the issue.
We will review your case and offer a suitable solution in line with our Refund and Withdrawal Policy.

Warranty Rights
Statutory warranty rights for defective goods remain unaffected.
Typical print-on-demand variations in color, print position or material structure do not constitute defects.

Platform Operation
Our online shop is operated via the technical platform Shopify.
Shopify is not a contractual partner for orders placed in this shop.
All purchases are concluded exclusively between you and seablub. 

Third-Party Tools and Links
Our services may provide access to third-party tools or links to third-party websites or content.
We do not control these third-party offerings and are not responsible for their content, availability, or accuracy.
Your use of third-party tools or websites is at your own discretion and risk, and is subject to the terms and policies of the respective providers.

Prohibited Use
You agree to use our services only for lawful purposes. In particular, you may not:

• use the services for fraudulent, abusive, or illegal activities,
• interfere with or circumvent security features of the website,
• attempt to gain unauthorized access to accounts, systems, or data,
• upload or transmit malware or harmful code.

We may restrict or terminate access to our services if we detect misuse.

Intellectual Property
All designs, artworks, texts, photographs, illustrations, brand names, and logos on this website are the property of seablub or our licensors.
Any reproduction, distribution, modification, or other unauthorized use is strictly prohibited.

Liability
seablub is liable without limitation for damages arising from injury to life, body, or health, and for damages caused intentionally or by gross negligence.
For simple negligence, we are liable only for breach of essential contractual obligations (cardinal obligations); in such cases, liability is limited to foreseeable, typical damages.
We are not liable for indirect or consequential damages or lost profits, where legally permissible.
Statutory warranty rights remain unaffected.

Final Terms
If any provision of these Terms of Service is or becomes invalid, the remaining provisions shall remain in full force and effect.
These Terms of Service, together with our Refund and Withdrawal Policy and our Privacy Policy, constitute the entire agreement between you and seablub regarding the use of our services.

Governing Law & Jurisdiction
These Terms of Service are governed by the laws of the Federal Republic of Germany.
The place of jurisdiction is Munich, where legally permitted.
